End User license agreement

AgriCount Terms of Service (EULA)

Effective Date: October 1, 2025

This End User License Agreement ("Agreement") is a binding agreement between Golden Cosmos Consulting ("Company," "we," or "us") and you ("End User," "you," or "your") governing your use of AgriCount, including all related documentation (the "Application").

1. LICENSE GRANT

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial use on a single mobile device owned or controlled by you.

2. LICENSE RESTRICTIONS

You shall not:

Copy the Application, except as expressly permitted by this license

Modify, translate, adapt, or create derivative works based upon the Application

Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Application

Remove, alter, or obscure any proprietary notices on the Application

Rent, lease, lend, sell, redistribute, sublicense, or transfer the Application

Use the Application for any unlawful purpose or in violation of any applicable laws or regulations

3. SUBSCRIPTION TERMS

3.1 Subscription Options

The Application offers the following subscription options:

Basic Monthly: $4.99 per month

Premium Monthly: $9.99 per month

Premium Annual: $59.99 per year

3.2 Auto-Renewal

All subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period at the cost of the chosen subscription.

3.3 Subscription Management

You can manage your subscriptions and turn off auto-renewal by going to your App Store account settings after purchase.

3.4 Free Trial

Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4. PRIVACY POLICY

Your use of the Application is subject to our Privacy Policy, which is incorporated by reference into this Agreement. Our Privacy Policy is available at https://goldencosmosconsulting.com/agricount/privacy.

5. USER CONTENT

The Application may allow you to create, store, and share content, including livestock data, property information, and media ("User Content"). You retain all rights in your User Content, and you grant us a worldwide, non-exclusive, royalty-free license to use your User Content as necessary to provide the Application's services to you.

6. TERMINATION

This Agreement is effective until terminated by you or us. You may terminate this Agreement by deleting the Application and all copies from your device. We may terminate this Agreement at any time without notice if you fail to comply with any terms herein, which will also terminate your license.

7. DISCLAIMER OF WARRANTIES

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.

9. GOVERNING LAW

This Agreement is governed by the laws of the United States and the State of California without regard to conflicts of law principles.

10. CHANGES TO THIS AGREEMENT

We reserve the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on this page and updating the "Effective Date" above.
